Buying Off-Plan Property in Georgia

How foreign buyers can purchase new off-plan homes in Georgia: who may buy, how ownership is registered, what it costs and how to check safely.

Can foreigners buy property in Georgia?

Yes. Foreign individuals and companies may buy apartments, houses, commercial premises and non-agricultural land in Georgia. Agricultural land, meaning arable land, pasture and homestead land, is generally closed to foreign buyers, so a new apartment in a developer's building is the usual route for overseas clients.

How ownership works when the building is not finished

Ownership passes only when you are registered as owner in the Public Registry, which is kept by the National Agency of Public Registry. Signing a contract or paying a deposit is therefore not the same as owning the home. Ask your agent to explain at which point in the developer's schedule your name will be entered in the registry.

The sale contract must be in writing. It is usually signed before a notary or at a Public Service Hall.

What extra costs should you plan for?

Georgia levies no property transfer tax. Registering your purchase costs a fee paid to the National Agency of Public Registry. Beyond that, ask the developer and your agent for a written list of every other charge before you sign, so nothing surprises you later.

How to buy safely from a distance

Public Registry records are open to anyone. Before buying, you can check a property's registered owner, mortgages and other restrictions. For an off-plan home, use this to look at the land and the developer's standing, and have the findings confirmed in writing.

Read the contract in full, ideally with a lawyer you trust, and make sure it is in writing and signed in front of a notary or at a Public Service Hall. Pay only through the channels named in the contract, and keep copies of every document and receipt.
